ARTICLE 1 – GENERAL PROVISIONS
The company SAS ZEPHYR OSC is a simplified joint stock company with capital of 1000 euros, registered with the RCS of the Registry of the Commercial Court of VERSAILLES under the number RCS Versailles 899 544 704, and whose head office is located at 5 rue Fénelon 33000 Bordeaux .
SAS ZEPHYR OSC is represented by its President, Mr. BAMY Charles.

SAS ZEPHYR OSC publishes and operates the Site https://le-filet-de-camouflage.fr , which markets camouflage nets and accessories.
The site https://le-filet-de-camouflage.fr is hosted by the company Shopify Inc., whose head office is located at 126 York St. Ottawa, ON K1N 5T5, Canada.
These General Conditions of Sale aim to define the contractual relations between the company SAS ZEPHYR OSC and the Buyer and the conditions applicable to any purchase of Products made through the website https://le-filet-de-camouflage. Fr .
These Conditions constitute a legally binding agreement which binds the Buyer to the company SAS ZEPHYR OSC and which governs its access to the site https://le-filet-de-camouflage.fr and its use, including its subdomains and all other sites through which LE FILET DE CAMOUFLAGE provides its Services.

“COMPANY”: designates the Company SAS ZEPHYR OSC represented by its President, Mr BAMY Charles and whose head office is located at 5 rue Fénelon 33000 Bordeaux.
“PARTY(S)”: refers individually to the Company or a Client and collectively to the Company and a Client.
“PRICE”: designates the price offered by the Seller for its offer to sell a Product.
“TRANSACTION PRICE”: designates the total price of the Product payable by the Buyer, including, in addition to the Sale Price of the Product, shipping costs defined as a flat rate.
“SITE”: designates the website of which the company SAS ZEPHYR OSC is the owner and publisher https://le-filet-de-camouflage.fr .
“USER”: means any person who uses the Site or one of the Services offered on the Site or by the Company.
ARTICLE 3 – PURPOSE
The purpose of these General Conditions of Sale is in particular to detail their scope of application as well as the conditions of their acceptance.
They describe the products offered for sale, the conditions under which Customers order said products, both with regard to the terms of payment, settlement and terms of execution, as well as the respective rights and obligations of the Parties.
The acquisition of a product through this site implies unreserved acceptance by the buyer of these General Conditions of Sale of which the buyer acknowledges having read prior to his order.
The company SAS ZEPHYR OSC retains the possibility, at its sole discretion, to modify or replace, at any time, all or part of these General Conditions of Sale, in order to comply with any new regulations or in order to improve the use of its site.
It is the User's responsibility to visit the Site regularly to check if any changes have been made.
Therefore, the applicable General Conditions of Sale will be those in force on the date of the order by the buyer.
ARTICLE 4 – PRODUCTS
The products offered are those which appear on the site https://le-filet-de-camouflage.fr of the company SAS ZEPHYR OSC while stocks last.
Each product is presented on the website in the form of a description listing its main technical characteristics (capacity, use, composition, etc.).
The description of the Product corresponds to its actual characteristics.
LE FILET DE CAMOUFLAGE mentions at least: the name of the product, the essential characteristics of the Product, its used state, the Transaction Price and, where applicable, the Product Code.
The photographs are as faithful as possible but do not commit the Seller in any way.
LE FILET DE CAMOUFLAGE undertakes to carry out all validations, verifications and provide all necessary details so that the description and elements of the offer are accurate and do not mislead the Buyer.
To ensure the aforementioned requirements, LE FILET DE CAMOUFLAGE reserves the right to modify the assortment of products at any time.

ARTICLE 5 – PRICES
The products are supplied at the prices in effect on the day the order is placed by the Customer on the site https://le-filet-de-camouflage.fr .
These prices are firm and non-revisable during their period of validity, as indicated by the Seller.
The prices appearing on the product sheets in the internet catalog are prices in Euros (€) all taxes included (TTC) taking into account the VAT applicable on the day of the order.
Any change in the VAT rate may be reflected in the price of the products.
The company SAS ZEPHYR OSC reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer.
The prices indicated do not include delivery costs (except when specified), invoiced in addition to the price of the products purchased depending on the total amount of the order and the agreed geographic area.
ARTICLE 6 – ORDERS AND PAYMENT TERMS
Any order for Products offered on the Site assumes express and unreserved prior acceptance of these General Conditions of Sale on the part of the Buyer, at the time of validation of his order, under the conditions and following the terms set out herein. Article.
By accepting these General Conditions of Sale, the Buyer:
- Declares having read all of their provisions;
- Acknowledges that he has benefited from the necessary advice and information, in order to ensure the suitability of the Products offered by the Seller with his needs;
- Declares being able to legally contract under French laws or validly represent the natural person for whom he is contracting.

Payments are made only using the payment method indicated on the Site.
The company SAS ZEPHYR OSC offers the buyer the opportunity to order and pay for their products in several stages, with a choice of payment option: secure payment by Paypal, secure payment by credit card, or secure payment by STRIPE.
The Buyer selects the products he wishes to order in the “basket”, modifies it if necessary (quantities, references, etc.), checks the delivery address or enters a new one.
Then, the shipping costs are calculated and submitted to the Buyer, as well as the name of the carrier (Mondial Relay, La Poste, Colissimo, etc.).
The Buyer then chooses the payment method of their choice: “Payment by PAYPAL”, “Payment by Credit Card” or “Payment by STRIPE”.
The next step asks him to check all the information, read and accept these General Conditions of Sale by checking the corresponding box, then invites him to validate his order by clicking on the “Confirm my order” button.
The Buyer has the possibility to check the details of his order, its total price and to correct any errors before confirming his acceptance.
Finally, the buyer is redirected to the secure PAYPAL, bank card or STRIPE interface in order to securely enter their PAYPAL, STRIPE or personal credit card account references.
Payment by PAYPAL account, by bank card or by STRIPE account is irrevocable.
In the event of fraudulent use of his bank card, the Buyer may request the cancellation of the card payment, the amounts paid will then be recredited or returned.
To obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the card holder must contest, in accordance with legal requirements, in writing, the debit with their bank, within 70 days following the operation, or even 120 days if the contract binding it to it provides for it.
The amounts withdrawn are reimbursed by the bank within a maximum period of one month after receipt of the written dispute filed by the holder. No costs for returning the sums may be charged to the holder.
In the event that, for whatever reason (opposition, refusal or other), the transmission of the flow of money owed by the Buyer proves impossible, the order will be canceled and the sale not made.
The Buyer acknowledges that his acceptance of the offer is made in consideration of the description of the Product subject to sale and that it constitutes a firm commitment to contract with the Seller under the conditions of the offer.
However, the sales contract is concluded under the condition that the Product ordered is available. Confirmation of the availability of the Product by the Seller entails the lifting of the resolutory condition.
In the event of invalidation of the availability of the Product, the sales contract concluded between the Buyer and the Seller is automatically and immediately terminated and the obligations of each party are automatically revoked.
It is specified that in the event of a sales contract relating to several Products, only the sales contract relating to the unavailable Product will be resolved.
Confirmation of an order entails acceptance of these General Conditions of Sale, acknowledgment of having perfect knowledge of them and waiver of the right to rely on one's own purchasing conditions.
All the data provided and the recorded confirmation will constitute proof of the transaction.
Upon receipt of a reservation confirmation from LE FILET DE CAMOUFLAGE a legally binding agreement is established with the Buyer.
An invoice is established by the Seller and sent electronically to the Buyer to the email address provided for each order.
The invoice mentions the name of the parties as well as their address and their billing address if different, the date of the sale or provision of service, the quantity, the precise name, and the unit price excluding VAT of the products sold and of the services rendered as well as any price reduction acquired on the date of the sale or provision of services and directly linked to this sale or provision of services, excluding discounts not provided for on the invoice.
The LE FILET DE CAMOUFLAGE Site is subject to a security system using SSL encryption in order to protect as effectively as possible all sensitive data linked to means of payment.
The credit card information communicated is encrypted through the use of the SSL security protocol and stored with AES-256 encryption.

The PAYPAL and STRIPE payment intermediaries used by LE FILET DE CAMOUFLAGE similarly have demanding encryption processes guaranteeing a reliable security protocol. Said processes are governed by the General Conditions specific to these intermediaries.
ARTICLE 7 – DISCOUNTS AND DISCOUNTS
The prices offered to the Buyer include discounts and rebates that the Seller may grant depending on the number, at one time, or the regularity of orders placed.
ARTICLE 8 – RESERVATION OF OWNERSHIP
The company SAS ZEPHYR OSC retains full ownership of the products sold until full payment of the price, in principal, fees and taxes included.
Notwithstanding the preceding paragraph, at the moment when the Buyer (or a third party designated by him) takes physical possession of the products ordered, the risks of loss or damage to the products are transferred to him.
ARTICLE 9 – DELIVERIES
The Products are delivered to the delivery address or Relay Point that the Buyer indicated during the order process, unless delivery restrictions indicated on the order validation page by the customer.
Orders are processed by Mondial Relay, La Poste or any other service provider available at the time of ordering, delivery service with tracking and, where applicable, delivery against signature.
Delivery times cannot exceed sixty days.
When the Buyer has ordered several products at the same time and they have different delivery times, the delivery time of the order is based on the furthest delivery time.
If delivery times exceed sixty days from the order, the Buyer has the option of resolving the contract under the conditions and terms defined in Article L.216-2 of the Consumer Code.
In the event that the Buyer has already received the Product, LE FILET DE CAMOUFLAGE will reimburse the product and the “outbound” costs under the conditions of Article L.216-3 of the Consumer Code.
Any delay in reimbursement following a failure to deliver exposes the Seller to an increase of 10% for a delay less than or equal to 30 days, 20% for a delay of 30 to 60 days and 50% for a delay greater than 60 days.
The company SAS ZEPHYR OSC via the Site https://le-filet-de-camouflage.fr will be able to provide the buyer with the tracking number of their package by e-mail.
The product is delivered to the buyer's home or to a relay point, depending on the choice made during the order validation process.
If the buyer is absent, he will receive a delivery notice from his postman, which allows him to collect the products ordered from the nearest post office, during a period indicated by the postal services.
The buyer is required to check, in the presence of the Post Office employee or the delivery person, the condition of the packaging of the goods and its contents upon delivery.
In the event of damage during transport, any protest must be made to the carrier within three days of delivery.
The seller's liability cannot under any circumstances be incurred in the event of delay or suspension of delivery attributable to the Buyer or in the event of force majeure.
ARTICLE 10 – TRANSFER OF PROPERTY AND TRANSFER OF RISKS
10.1 – Transfer of ownership
The transfer of ownership of the Products to the benefit of the Buyer will only be carried out after full receipt of the price by the Seller, regardless of the date of delivery of said Products.
10.2 – Transfer of risks
The transfer of risks is independent of the transfer of ownership, regardless of the date of the order or delivery of the products.
The transfer to the Buyer of the risks of loss and deterioration of the products will only be made after delivery of the Product, when said Product is received by the Customer.
ARTICLE 11 – FORCE MAJEURE
The Parties cannot be held responsible if the non-performance or delay in the performance of any of their obligations, as described in these Conditions, results from a case of force majeure, within the meaning of article 1218 of the Civil Code.
ARTICLE 12 – RIGHT OF WITHDRAWAL
12.1 – Legal deadline for the right of withdrawal
In accordance with the legal provisions in force, the Buyer has a period of 14 days from receipt of his Products to exercise his right of withdrawal without having to give reasons or pay a penalty.
After communication of his decision to exercise his right of withdrawal within this 14-day period, the Buyer has another 14 days to return the product(s) concerned by the withdrawal.
12.2 Conditions for exercising the right of withdrawal
If the right of withdrawal is exercised within the period referred to in 12.1, only the price of the product(s) purchased and the shipping costs will be refunded, the return costs remaining the responsibility of the Buyer.
Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.) allowing them to be remarketed in new condition, and, if possible, accompanied by a copy of the purchase invoice for a optimized management.
In the event of depreciation of the product resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the product, the Buyer may be held liable.
To exercise his right of withdrawal, in accordance with legal provisions, the Buyer will find attached in Appendix 2 of these General Conditions of Sale, a standard withdrawal form to be sent, by post, to the following address: SAS ZEPHYR OSC, 5 rue Fénelon 33000 Bordeaux or by e-mail: serviceclient@le-filet-de-camouflage.fr .
The Buyer expresses his desire to withdraw without any ambiguity and mentions the order concerned by this withdrawal.
Once the withdrawal form or declaration has been sent at the latest within 14 days of receipt of the order, the Buyer must return the product(s) concerned, within a reasonable time and, at the latest, within 14 days to from the sending of the form or the declaration of withdrawal.
In order to obtain an estimate of the return costs payable by him, the Buyer can go to the La Poste website, Colissimo “PRACTICAL RATES AT POINTS OF SALE (Post Offices and Colissimo Agencies).
This estimate of return costs does not bind the Company SAS ZEPHYR OCS. The price to pay for returning the product may vary depending on the carrier that the Buyer chooses to return the product(s).
If the Customer is shipping an item worth more than €75, they are advised to use a delivery service that allows them to track the shipment or to take out delivery insurance.
LE FILET DE CAMOUFLAGE cannot guarantee the correct receipt of the item returned by the Buyer.
12.3 - Products excluded from the right of withdrawal
In accordance with current regulations, the right of withdrawal cannot be exercised for audio, video or computer software recordings unsealed by the customer, goods made according to the customer's specifications or personalized and goods unsealed by the customer and which cannot be be returned for reasons of hygiene or health protection. Likewise, the right of withdrawal cannot be exercised for gift boxes.
12.4 - Return address

12.5 – Reimbursement
In the event of exercising the right of withdrawal, the Company SAS ZEPHYR OSC will reimburse the sums paid no later than 14 days from the date on which the Company is informed of the Buyer's decision to withdraw and using the same means of payment as that used for the order (unless the Buyer expressly agrees to reimbursement using another means of payment).
This reimbursement date may be deferred until recovery of the product or until the Buyer has provided proof of shipment of the product, the date chosen being that of the first of these events.
In the absence of a reimbursement after 14 days from the date on which the Company is informed of the Buyer's decision to withdraw, LE FILET DE CAMOUFLAGE is liable to reimburse the sums due increased by the legal rate if the delay reimbursement is less than 11 days, 5% if the delay is between 10 and 20 days, 10% if the delay is between 20 and 30 days, 20% if the delay is between 30 and 60 days, 50% if the delay is between 60 and 90 days.
SAS ZEPHYR OSC is not required to reimburse the Buyer for additional costs if the latter has expressly chosen a more expensive delivery method than the standard delivery method offered on https://le-filet-de-camouflage .Fr .
Reimbursement of purchases made by gift vouchers will be made exclusively in the form of gift vouchers for an amount identical to that paid in this form.
The advantages obtained when purchasing a product, in particular through a loyalty card, will be canceled in the event of return of the product accompanied by a reimbursement of said product.
ARTICLE 13 – LEGAL GUARANTEES
13.1 - Legal guarantee of conformity
In accordance with legal requirements (Appendix 1), the company SAS ZEPHYR OSC is liable for defects in conformity appearing on its products for two years (2) from the delivery of the goods. It is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when this has been its responsibility by the contract or has been carried out under its responsibility.
It is recalled that as part of the legal guarantee of conformity, the consumer:
- benefits from a period of two years from delivery of the goods to act vis-à-vis its seller;
- can choose between repairing or replacing the item, subject to the cost conditions provided for in Article L. 217-9 of the Consumer Code;
- is exempt from providing proof of the existence of the lack of conformity of the goods during this period; in fact, defects in conformity which appear within 2 years following the delivery of the product are presumed to have existed at the time of its delivery unless proven otherwise by the professional.
The legal guarantee of conformity applies independently of the commercial guarantee which may potentially cover the Buyer's property.
13.2 – Guarantee against hidden defects in the item
It is recalled that the consumer can decide to implement the guarantee against hidden defects in the thing sold within the meaning of article 1641 of the Civil Code within two years from the discovery of the defect.
It is up to the Buyer to prove in particular that the defect existed at the time of purchase, that it was hidden and that it renders the product unusable.
The Buyer can choose between canceling the sale or reducing the sale price in accordance with article 1644 of the Civil Code.
This guarantee thus allows the Buyer to obtain the repair of his product or its exchange free of charge, subject to the cost conditions provided for by law.
Failing this, if the repair or exchange is impossible or could not be implemented within the month following its acceptance, SAS ZEPHYR OSC will reimburse the Buyer the price of the Product.
To exercise this guarantee, the Products must be returned in the condition in which the Buyer received them with all the elements (accessories, instructions, etc.) as well as a copy of the purchase invoice.
Products returned by post must be in packaging allowing transport in good conditions. In this case the costs of returning the product will be reimbursed to the Buyer on the basis of the price invoiced and upon presentation of supporting documents.
13.3 – Exclusion of legal guarantees
Any warranty is excluded in the event of misuse, negligence or lack of maintenance on the part of the Buyer, as well as in the event of normal wear and tear of the Product or in the event of force majeure.
ARTICLE 14 – INTELLECTUAL PROPERTY
The content of the LE FILET DE CAMOUFLAGE website, its name, its brand, its logo, its products are registered with the National Institute of Industrial Property (INPI) and constitute the property of the company SAS ZEPHYR OSC
They are protected by French and international laws relating to intellectual property.
Any total or partial reproduction of this content, adaptation, modification, distribution is strictly prohibited and may constitute an offense of counterfeiting.
You may not use, adapt, modify, create derivative works from, distribute, license, sell, transfer, publicly perform, transmit, broadcast or otherwise exploit any another way the site https://le-filet-de-camouflage.fr .
In addition, the company SAS ZEPHYR OSC remains the owner of all intellectual property rights over the photographs, presentations, studies, drawings, models, prototypes, etc., produced with a view to providing the Services to buyers.
